ADVERISER REPONSIBILTY TERMS

The purchasing of advertising by any company herein referred to as "The Sponsor" formally enters into agreement with Nfusionforum.com herein referred to as "The Company" for advertisement purposes only herein referred to as "the service", no other agreement is expressed or implied through this agreement.

WARRANTY DISCLAIMER.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE COMPANY'S ADVERTISING SERVICES ARE PROVIDED "AS IS" AND THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND, FOR ADVERTISING SERVICES AND ANY OTHER MATERIAL PROVIDED TO THE SPONSOR BY THE COMPANY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. THE COMPANY DOES NOT WARRANT THAT THE SERVICES ARE ERROR-FREE, OR THAT THEIR OPERATION WILL BE UNINTERRUPTED, OR THAT SERVICE WILL MEET ANY PARTICULAR USER REQUIREMENTS.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE COMPANY MAKES NO WARRANTY, AND PROVIDES NO ASSURANCE, THAT THE PRODUCTS WILL MEET SPECIFIC REQUIREMENTS OF ANY REGULATORY AUTHORITY OR OTHER ASSOCIATION LICENSING AGENCY, WITHIN OR OUTSIDE OF THE STATE OF TEXAS OR THE UNITED STATES.

 

LIMITATION OF LIABILITY.

Except as specifically provided herein, neither the Company, its affiliates, resellers, agents, or licensors, if any, shall be liable for any claim, demand or action arising out of, or relating to, the User's use of the service or the Company's performance of (or failure to perform) any obligation under this Agreement or for special, incidental or consequential damages, including, without limitation, damages due to lost revenues or profits, business interruption, or other damages caused by The Sponsor's inability to use the Products, even if the Company, its affiliates, resellers, agents, or licensors have been advised of the possibility of such loss or damages, and whether or not such loss or damages is or are foreseeable.

The Company is in no way responsible for site or Internet downtime. As The Sponsor rents a banner for a specified period of time The Company Assumes no responsibility in the event that The Sponsor's site, products, or services are unavailable during that time. The Company has no obligation to extend advertising due to these circumstances.

TRUTH IN ADVERTISING / INDEMNIFICATION FOR LIABILITY:

The Sponsor is solely responsible for any legal liability arising out of or relating to (1) The Service, and/or (2) any material to which users can link to through the Advertisement. The Sponsor represents and warrants that the Advertisement and Link comply with Local Federal and International Law; and that it holds the necessary rights to permit the use of The Service by The Company for the purpose of this Agreement; and that the use, reproduction, distribution, or transmission of the Advertisement will not violate any criminal laws or any rights of any third parties, Including; but not limited to: infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertisement, unfair competition, defamation, invasion of privacy or rights of individuals celebrity, or otherwise, violate any anti-discrimination law or regulation, or any other right of any person or entity.

LIMITATION ON DAMAGES:

IN NO EVENT WILL NFUSIONFORUM.COM  OR THE MODERATORS, ADMINISTRATORS, BE LIABLE TO SPONSOR FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT NFUSIONFORUM.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

The Sponsor is NOT allowed to place ads to fraudulent sites, investment scams, or Ponzi Schemes or any illegal activity. Additionally, Site Sponsors and or their agents, MAY NOT engage in HARVESTING members, soliciting, or redirecting to other FORUMS. We reserve the right to immediately revoke current and decline any future service to The Sponsor of The Service in the event a credible complaint is filed with The Company at it's own discretion.  In such an event The Company is not obligated to refund, prorate, transfer, or reimburse The Sponsor for losses, damages, or expenses incurred. The Company is in no way affiliated with any of our advertisers and are not responsible for their actions.

You agree to indemnify, defend and hold NfusionForum, and it’s members harmless from and against any third party claim, loss, liability, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s) or The Company, arising out of Your use of The Service, Your Web site, and/or Your breach of any term of this Agreement.

The Sponsor agrees to indemnify The Company and to hold save harmless The company, it's affiliates, and it's management and members from any and all liability,loss,damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by The Company, arising out of or related to Advertiser's breach of any of the foregoing terms, representations and warranties. The Sponsor agrees to request that The Company be listed as an additional insured on any policy issued to The Sponsor pursuant to which there could be coverage for any of the forms of legal liability described in this paragraph.

NfusionForum also does not accept advertising for alcohol, tobacco, firearms or pornography. NfusionForum does NOT promote any gambling, or any illegal activity, implied or explicit. NfusionForum does not allow popup advertising by 3^rd party advertisers.

 

Advertisements Are Not Targeted To You

Advertisers and sponsors may target their messages to specific NfusionForum sections or categories within our site, but NfusionForum, does not target advertisements to individual users on our site. In other words, we do not use personal information about you to determine which advertisements you will see when you visit our site.

 

NfusionForum does not receive commissions on purchases you may make when you leave NfusionForum, or our clients' Web sites to visit the site of a company advertising on NfusionForum, or our clients' sites, with the following exception: we may receive a commission under certain agreements.

 

No Advertorials

NfusionForum does not accept "advertorial" articles. In other words, our site does not display NfusionForum Sections or information provided by companies who advertise on our site.

 

Sharing Aggregate User Information

 

NfusionForum may share aggregated, anonymous statistical information regarding site usage and traffic patterns with our advertisers and sponsors.
